Do NOT guess - make sure you use the effective date of your existing gun trust. This is crucial.

TIP - Since you already have a standard estate planning trust, be sure to name your gun trust a different name.  Both trusts cannot have the same name.  If your standard estate planning trust is named the "Smith Family Trust" it is acceptable to name your gun trust the "Smith NFA Trust"

This is the name of your gun trust. If you are restating an existing trust, you MUST use the exact same name as your existing trust (including spaces and capitalization). You do not have to use "gun" or "NFA" in it, but please have the word "Trust" at the end of the name. Using the word "gun" in the trust name is fine, legally speaking, but it may cause a few problems if you decide to set up a trust bank account because some banks are not gun friendly. The shorter the name the better, especially if you are ever going to build your own NFA item using a form 1. The trust name will have to be engraved on the item. Please use this format: "Smith NFA Trust"

Trustees

Trustees are people who have the ability to hold and use the trust assets. They also have authority to direct the affairs of the trust. All trustees have the legal ability to possess trust-owned NFA firearms alone (without you being present). Trustees must be at least 18 years old and be legally able to possess guns. You (and your spouse if you are married) will be the initial trustee(s) of the trust. Other trustees (successor trustee, additional initial trustees) should be people that you trust greatly for they will have nearly as much power as you. The Successor Trustee only obtains power once you die or become disabled - they have no power during your life. Additional initial trustees are "co-trustees" with you and have a great deal of power during your lifetime, including the legal ability to possess trust-owned NFA firearms outside of your presence. Trustees and beneficiaries can be the same person(s), or completely different people. Trustees are not limited to family members - they can be friends or other loved ones.

Full name of the person you want to manage the trust assets after you (and your spouse if you are married) have died or became incapacitated. List only one person. This should NOT be your spouse (if you are married, they are already included in the trust). Use this format: Jake J. Doe

Beneficiaries

Beneficiaries are the people who the trust is set up to benefit in the long run.  These are the people that you want to be able to receive the firearms after your death.  They can also use them during  your life with your permission and in your presence. Typically, people name their children as beneficiaries, however, you can name other people are not family members as beneficiaries if you so choose.  The distribution to your beneficiaries will be outright, which means your successor trustee will complete the necessary ATF paperwork (tax exempt form 5) to deliver the NFA firearms (and other trust assets) to your chosen beneficiaries.  The items will not continue in trust after your death.  If you desire for your trust to continue after your death, you need to use either the Rapid Fire Gun Trust or the AZ Advanced Gun Trust.  Trustees and beneficiaries can be the same person(s), or completely different people.

List the full names of all of beneficiaries. Use a simple space and comma in between the names. If you only have one beneficiary, that is okay, however you need at least one beneficiary. Use this format "Jack Doe, Jenny Doe, and Jeff Doe" (no period at the end)
